Official Rules
1. NO PURCHASE NECESSARY TO ENTER: The "Take The Pledge" Contest (The "Promotion") begins at 10:00 AM Pacific Standard Time (United States) on September 24, 2003 and ends at 11:59 PM Eastern Standard Time (United States) on October 24, 2003 ("the entry period"). All prizes will be awarded. The Promotion is open to legal residents of the United States, except Puerto Rico, the U.S. Virgin Islands and where otherwise prohibited by law, who are 18 years of age or older. Void where prohibited by law.
2. HOW TO ENTER: To be entered in the contest, simply visit autobytel.com (www.autobytel.com) during the entry period and use the promotion referral page to refer friends and family to take the "Pledge" via an automated email message. Your referred friend must click through from the email sent, to www.autobytel.com during the promotion period, and fill out the online Pledge form with their name and email for your referral to be valid. The contest participant with the most valid referrals during the promotion period will win the Grand Prize. Refer as many friends as you wish, but each referral must be a unique individual, with unique name and email address. Last chance to enter is October 24, 2003. Responsibility for receipt of entry rests solely with the entrant. Each on-line Pledge will be deemed to have been submitted by the record holder of the email address from which the Pledge originated. All Pledge entries become the property of Sponsor and will not be acknowledged. All terms and conditions established by the Sponsor in connection with the contest, or as may hereafter be determined by Sponsor, shall apply.
3. PRIZE AND ODDS: One (1) Grand Prize: $5,000 Safe Driving Initiative; a prize of $5,000 shall be awarded to fund a Safe Driving Initiative in the winner’s neighborhood/community (ERV $5,000). The winner will also receive professional consultant services to assist in the utilization of the funds; Total ERV for prize is $5,000. Odds of winning are dependent upon the number of eligible entries received. Prize will be awarded. Grand Prize winner will be selected on or about October 31, 2003. Grand Prize winner will be determined by an independent judging organization whose decisions are final on all matters relating to this contest and based on the most Pledges taken from entrant’s referrals during the promotion period. In the event of a tie, a random drawing will be held by the same independent judging organization, between the entrants that have tied with most referral Pledges. Prizes are non-transferable and no substitutions are allowed, except by the Sponsor, who reserves the right to substitute a prize of equal or greater value. All taxes, fees and surcharges on prize are the sole responsibility of the winner.
4. VERIFICATION OF WINNER AND DELIVERY OF PRIZE: Grand Prize winner will be notified by certified mail and will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. Prize may be forfeited or awarded to alternate winner if affidavit and release are not returned within 14 days after mailing to winner or if prize notification letter and releases are returned as undeliverable. The Grand prize winner must also sign an agreement stating that the $5,000 prize will be used solely and exclusively for a legitimate safe-driving initiative in the winner’s community.
BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT AUTOBYTEL, ITS SUBSIDIARIES, AFFILIATES, PARENTS, ADVERTISING AGENCIES, PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR, ANY LIABILITY, ANY LOSS OR DAMAGES OF ANY KIND DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM RECEIPT, ENJOYMENT OR USE OF PRIZE AND PARTICIPATION IN THIS PROMOTION. Acceptance of prize and signing of publicity release constitutes permission to Autobytel Inc. to use winners’ names and likenesses for promotional purposes without further compensation except where prohibited by law.
5. ELIGIBILITY: Contest is open to individual legal residents of the United States, except Puerto Rico, the U.S. Virgin Islands and where otherwise prohibited by law, who are 18 years of age or older as of September 24, 2003. Employees of Autobytel, its affiliates, parents, subsidiaries, advertising agencies, promotion agencies, and immediate family members and persons with whom each of the above are domiciled are not eligible to win.
6. GENERAL: This contest is void where prohibited or restricted by national, state or any other governmental laws. This contest is subject to all federal, state, provincial, municipal and local laws and regulations. This contest will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this contest must be brought in a court of competent jurisdiction within the United States of America. The Sponsor, its respective agencies and employees assume no responsibility for incorrect, inaccurate, incomplete, lost, late, garbled, or misdirected Pledge referrals or Pledge form entries. The Sponsor, its respective agencies and employees assume no responsibility for errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user’s Internet service provider and/or email client or for insufficient space in user’s email account to receive email. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with this contest and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or affect that administration, security, fairness or proper conduct of the contest. By entering the contest, entrant accepts and agrees to be bound by these Official Rules and the decisions of the judges, which shall, in all respects, be final. Entrants who (i) disregard these Official Rules or (ii) act in any way to disrupt contest or the site wherein such contests are being promoted or (iii) otherwise interfere with the operation, integrity of, or personnel associated with the contest may be declared ineligible and have their access to this or other Autobytel sponsored promotions blocked or voided.
7. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
